AGREEMENT OF RELEASE AND WAIVER OF LIABILITY

This Agreement ("Agreement") is entered into between the Guest (‘The client’) and Mandeja Heavenly ("Company"), operated by Mandeja Heavenly/Samantha Barnett, for booking and participating in the booked Hands On Transformational Therapy or Retreat conducted by Mandeja Heavenly/Samantha Barnett.

At first contact, I ‘the client’ am fully committed to my healing and Transformational journey before booking.

I ‘the client’ understand that this is an investment in myself that will require a commitment of time, money, motivation, strength, energy, and vulnerability, honouring and giving myself the space to expand, transform and evolve.

At the time of booking I ‘the client’ and Mandejá Heavenly/Samantha Barnett, have entered into an agreement to work together at the date and time specified for the agreed Hands On Transformational Therapy or Retreat with integrity, honesty and a commitment to my healing journey.

BOOKING TERMS AND CONDITIONS:

By booking or participating in the Hands On Transformational Therapy or Retreat, I ‘the client’ agree to the following Terms & Conditions.

I ‘the client’ will participate in activities offered by the hosts and other guest speakers/therapists, and understand that the offerings of this Hands On Transformational Therapy or Retreat are not a substitute for medical attention, examination, diagnosis, or treatment and that I ‘the client’ is solely responsible for my healing and spiritual journey.

I ‘the client’ will participate in the health, spiritual and wellbeing related information and instructions/Workshops/Meditations/Coaching and Mentoring during my Hands On Transformational Therapy or Retreat and I ‘the client’ am solely responsible for any decisions I make moving forward with this information.

I ‘the client’ recognises that all walking, workshops, integration days in nature, walks on the beach, coastal paths, stairs may require some physical exertion that may be strenuous and may cause physical injury. If at any time during the activities I ‘the client’ feels discomfort or pain, I ‘the client’ will inform and seek assistance from Mandeja as soon as possible. 

I ‘the client’ is fully aware of the risks and hazards outlined above and will work at my own pace and will tell Mandeja if I ‘the client’ have any concerns on my physical health.

FOOD AND BEVERAGES:

I ‘the client’ will receive 4 fruit and vegetable antioxidant and anti-inflammatory juices a day - 8am, 11am ,3pm, 7pm, Brunch at 11am, Dinner at 7pm, with an optional healthy snack at 3pm.

I ‘the client’ will receive alkaline filtered water, herbal teas available throughout the Retreat. 

The Retreat is a cleanse and therefore no alcohol, drugs or other substances must be consumed 4 weeks before the Retreat or during. 

I ‘the client’ agree to stay sober of those substances for 4 weeks before and during the retreat, making my own decisions moving forward.

I ‘the client’ may rest at any time during the retreat as well as at the designated free time during each day. I ‘the client’ will listen to my body and respect its limits on any given day.

I ‘the client’ understand that it is my responsibility to consult with a physician prior to and regarding my participation in any activity, vegetarian menu, freshly cold-pressed juicing or intermittent fasting with two meals or retreat program of workshops and activities.

I ‘the client’ represent and warrant that I am physically fit and I have no medical condition that would prevent my participation in fitness classes or workshops at the retreat.

I ‘the client’ recognise that it is my responsibility to notify Mandejá of any serious illness or injury before every session.

I ‘the client’ accept that neither the instructors, nor those the hosting retreat, are liable for any injury, or damages, to my person or my property, resulting from my participation in the retreat.

ROOM ALLOCATION:

Rooms will be allocated at the discretion of Mandejá, based on your Booking results.

NON-REFUNDABLE DEPOSIT

Upon paying your non-refundable deposit you enter into an agreement with the terms and conditions on Mandejá’s cancellation policy https://mandejaheavenly.com/blog-1/f/cancellation-policy (Reviewed August 2023)

I ‘the client’ understand that the deposit for the Retreat is final with no refunds and the balance is  either paid in full or in three instalments as agreed with Mandejá.

EXCLUSION OF PARTICIPATION:

In the unfortunate circumstance, if I ‘the client’ conceals physical and/or health issues, is unfit, and/or causes disruptions that endanger the provision of the service and/or the health of other participants, facilitators, or causes damage to the property or equipment, I ‘the client’ WILL be excluded from the participation of the Retreat after an initial warning and request to calm behaviour.

If there are causes for concern and I ‘the client’ do not heed warnings, the retreat contract will be terminated with immediate effect, and I ‘the client’ shall be asked to leave as soon as possible.

All payments, deposits, either Full price or instalments as already paid ‘costs’, are non-refundable and if I ‘the client’ damage any of the property, I ‘the client’ shall incur the full cost of the ‘Damages of £100’ as required by Mandejá to be paid to Mandejá Heavenly directly.

RETREAT PACKAGE EXCLUSIONS:

The Retreat package does not include the following:

International or domestic airfare or travel to the Retreat Accommodation.

Optional extras and activities (Any meals, activities, or tours not listed in the Retreat package inclusions).

Mandatory travel insurance (as stated in the terms & conditions above).

Personal expenses for gifts. 

ENTIRE AGREEMENT:

This Agreement represents the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the retreat herein.

LIABILITY:

Mandejá Heavenly/Samantha Barnett shall not be liable for any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care.

Such circumstances or events include but are not limited to, pandemic outbreak, war or threat of war, riot, civil unrest, industrial disputes or strikes, accidents or failure to perform by third parties, including suppliers and subcontractors, unavoidable technical problems with the accommodation, transport or closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions.

In the event of any of the above, refunds and compensation payments cannot and will not be made associated costs will have been incurred.

Mandejá Heavenly/Samantha Barnett accepts no liability for loss, damage, injury or illnesses that may be received during the guest’s stay or travelling to and from Mandejá Heavenly/Samantha Barnett Retreats.

All guests must take responsibility for their own medical and physical fitness and be able to use our facilities and participate in activities.

Mandejá Heavenly/Samantha Barnett shall not be liable for any injuries or losses to guests, in the use of retreat facilities or participation in activities.

While all care is taken, Mandejá Heavenly/Samantha Barnett cannot accept any responsibility for the loss or damage of personal possessions or valuables of guests.

All guests must take responsibility for their own medical and physical fitness and be able to use retreat facilities and participate in activities. This includes but is not limited to weather, noise, construction, fire ceremonies and other general activities.

DATA PROTECTION:

I ‘the client’ agree to be photographed and/or filmed during my stay and/or activities in connection with the retreat, and also agrees that Mandejá Heavenly/Samantha Barnett may use such recordings for promotion and/or advertising purposes without any other prior consent.

Mandejá Heavenly/Samantha Barnett respects and understands the nature of the events undertaken at the retreat and will use their best efforts to respect the privacy of the guest to ensure they are not exposed personally in vulnerable situations.

I ‘the client’ will sign the GDPR form in wet ink upon arrival and check in.

I acknowledge that Mandejá Heavenly will not share my data with any third party and that Jotform.com acknowledges in their Terms and Conditions section 6 that Mandejá has sole responsibility for any information collected and Jotform.com does not own any data.

I ‘the client’ have read the above AGREEMENT OF RELEASE AND WAIVER OF LIABILITY and fully understand its contents as well as the Refund/Cancellation Policies.

I ‘the client’ have read, understood and voluntarily agreed to the terms and conditions stated above and agree to these terms and conditions once I have booked, and paid my deposit, full payments or first instalment, as appropriate.
